Beating Speeding Tickets With A Professional Speeding Barrister

Many people assume that because the police are able to provide a photograph that allegedly showing them speeding, that it is an open and shut case but this is not true. The court still listens to evidence from both sides in order to determine whether the prosecution can prove beyond reasonable doubt that the driver has been guilty of the speeding offence they are accused of. As such, speeding tickets are not absolute and you may be able to avoid the fine and points that accompany them.

The police use a whole array of different types of camera and speed recording equipment in a bid to try and catch speeders. This same equipment usually also provides photographs of the vehicle accompanied by the speed at which it was travelling. This is typically given as evidence in a court case to help prove the case for speeding tickets.

However, with more than 50 different varieties of speeding camera and equipment on the roadside, in police cars, and carried by traffic officers, it is essential that the officer in charge of a particular piece of equipment follows the appropriate procedures while setting the camera. A failure to do so can void any speeding tickets that are created during the use of that equipment. Going to court and contesting speeding tickets is the only way to find out if this affects you.

A professional barrister or solicitor will cross-examine the officer in order to determine the actions they took when setting up the camera for use. They will know the exact procedures that should be followed and through cross examination will be able to determine whether the readings were necessarily accurate or not. If the officer did not follow the appropriate procedures then this can lead to your being acquitted and not having to pay the fine or take the penalty points.

Speeding tickets and camera photographs are not absolute proof that a driver has been guilty of speeding and the prosecution must prove beyond all reasonable doubt that the driver was speeding and that they followed all procedures properly when setting the camera up ready for use.
