Has Our Litigious Society Made us Safer?


Our ‘No Win, No Fee’ culture has meant that a great many businesses have had to change their approach to health and safety. But has this litigious culture actually made us safer in the workplace or has it just served to drive up companies’ overheads needlessly?

The culture of no win, no fee proceedings is mostly about exploiting loopholes in the law to get money out of businesses and in turn increase the cost of everything from legal fees to premiums. Whilst some genuine cases are resolved through such means, a great deal of injuries that were not actually a company’s fault can be claimed against. Best practice advice and the law are very different things and it is now important for companies to be covered against the results of both.

Another result of this is that the paper trail for risk assessments seems to just get bigger and bigger. And from the cost of excessive risk assessments to the cost implementing the procedures these suggest, companies are paying a huge amount of money, predominantly out of fear.

For companies who want to save money, health and safety courses can be a great way forward. Not only will it reduce the cost of hiring in consultants regularly, but many of the procedures that cost huge amounts of money can in many cases be catered for in-house, keeping staff safe and reducing overheads for businesses at the same time.

The no win, no fee culture probably hasn’t made us safer at all, but it has made us more scared and it has also made the cost of running a business far greater as a result. By using health and safety courses to have the expertise on hand, some of that money can be saved without you having to worry about any negative consequences.
